Professor David Glazier appeared on CNN's Legal View to discuss the release of Bowe Bergdahl, an army sergeant held captive by the Taliban in Afghanistan. He opined on the relevance of a statute requiring Congress be notified within 30 days of the release of a Guantanamo prisoner.
"Well, the question, of course, becomes, has the president complied with the statute? And it appears facially that he hasn't complied with the direct language of the statute. But the larger question is, is this statute, in fact, the applicable law? Because under the Constitution, the Constitution itself is the supreme law of the land. And if the president has the constitutional authority to conduct an action, then Congress can't deny him that authority by simply passing a statute. "
