The judge’s determination will likely come down to whether the requested financial documents were created as part of an ongoing court case or as part of the city’s normal record-keeping procedures, according to Jessica Levinson, a professor at Loyola Law School.
“It depends on the major purpose for which the billing was prepared,” she said.
