Ides questions need for "originalist" on Supreme Court in op-ed for The Sacramento Bee
Professor Allan Ides writes an op-ed for The Sacramento Bee pointing out potential pitfalls of Supreme Court nominee Judge Neil Gorsuch’s "originalist" approach toward interpreting the Constitution. This approach focuses on interpreting the Constitution based on the values held in 1789. Professor Ides notes:
Originalism is usually endorsed as the alternative to a regime under which judges are free to rewrite the law in service to their personal vision of morality. This appears to be Gorsuch’s view. But the sensible alternative to originalism is not free-range activism, but pragmatism, a perspective that can accommodate a wide range of political views.
